Garbage Ordinances
RESIDENTIAL GARBAGE AND TRASH COLLECTION
Definitions For the purpose of this chapter certain words, terms, and phrases shall apply: (A.) Ashes-Refuse resulting from the burning of wood, coal, coke, and other combustible material. (B.) Building Rubbish-Rubbish from construction, remodeling and repair operations on houses, commercial buildings, and other structures, including but not limited to excavated earth, stones, brick, plaster, lumber, concrete, shingles, insulation and waste parts occasioned by installations and replacements of structures and facilities. (C.) Garbage-Paper, animal and vegetable refuse resulting from the handling, preparation, cooking, and consumption of food, including a minimum amount of liquid necessary incident thereto. (D.) Mobile Refuse Containers-Refuse containers as supplied by the Town of Fuquay-Varina with a minimum capacity of eighty (80) gallons, designed for storage of residential and small business refuse and capable of being automatically dumped by the Town residential collection equipment. (E.) Refuse-solid waste, including but not limited to garbage, rubbish and ashes. (F.) Sanitary-Conditions or methods promoting or insuring cleanliness, health, hygiene and the prevention of disease. (G.) Trash-Refuse (exclusive of garbage and ashes) including but not limited to paper, rags, cartons, boxes, wood, excelsior, leather, tree, bush and hedge branches, cutting and trimmings, yard trimmings, grass, leaves, tin cans, metals, small mineral matter, glass, crockery, dirt, earth, and dust. Construction and demolition material is not defined as trash.
Section 4-2006. Residential Garbage Collection.
(A.) All occupants of single-family residences and of single-story multifamily residences not exceeding four (4) dwelling units shall deposit all garbage and refuse in mobile refuse containers provided by the Town and place said containers adjacent to the street for collection on the day(s) designated by the Public Works Director for pickup. Resident-owned townhouse and condominium complexes may elect this form of collection or the large container collection described in Section 4-2005. The Director of Public Works may provide mobile refuse containers to small offices and businesses with a low volume of refuse if he deems this system more sanitary and efficient. The mobile refuse containers shall be placed within five (5) feet of the curb or street edge or in an accessible location approved by the Public Works Director, but shall not be placed in the street. (B.) The containers shall be placed in the required location for collection no earlier than 7:00 p.m. on the day proceeding a designated pickup day and shall be removed from the curbside location no later than 7:00 p.m. after the container has been emptied. Except during these prescribed hours, the mobile containers and all other refuse containers shall be kept in a location no closer to the street than the front line of the residential structure. (C.) The containers shall remain the property of the Town and are provided and assigned to residences for the health, safety, convenience, and general welfare of the occupants. Containers that are damaged, destroyed, or stolen through abuse, neglect, or improper use by the owner/occupant shall be replaced by the Town at the expense of the occupants or the owner of the residence. Containers which are damaged in the course of normal and reasonable usage or which are damaged, destroyed, or stolen through no abuse, neglect, or improper use of the owner/occupant shall be repaired or replaced by the Town at no charge to the occupant or resident owner. The containers shall not be damaged, destroyed, defaced, or removed from the premises by any person. Markings and identification devices on the containers, except as placed or specifically permitted by the Town, are expressly prohibited and shall be regarded as damage to the containers. The occupant/owner shall maintain the container in a clean and odor free condition. (D.) Mobile refuse containers may be used for the disposal of items of household trash in addition to household garbage. However, the following materials shall not be placed on or within the containers: grass clippings, leaves, shrubbery trimmings, pine straw, rocks, dirt, sod, gasoline, oil, flammable liquids, solvents, hot coals or ashes, or building materials. Violation of these prohibitions will be treated as abuse and improper use of the container. In addition, no pet litter, animal waste or disposable diaper shall be placed within a mobile refuse container or other container for collection unless the material is first thoroughly sealed within a plastic or paper bag. (E.) A variation to the requirements of this section related to placement of the container for collection may be considered only after a request is made to the Director of Public Works by a written form (obtained from the Public Works Department) explaining determination if a variance is appropriate. (F.) Any citizen not served by Town sewer and water, shall be required to make a deposit for the mobile refuse container and pay a monthly fee for garbage collection according to the refuse collection fee schedule. (G.) The owner or occupant responsible for the mobile refuse containers shall be responsible to notify the Town when moving or no longer requiring the mobile refuse container. The Town shall remove the container and inspect it to insure it has not been damaged. If damages are determined to exist according to the regulations of this chapter, the owner or occupant shall be assessed according to the refuse collection fee schedule. (H.) The owner or occupant is responsible to locate the mobile refuse container at the curb or edge of street for collection. No garbage, trash or refuse shall be collected unless it is in an approved container or assembled in accordance with this code. The owner or occupants who fails to comply with the requirements of placing garbage, trash, or refuse at the curb or edge of the street on their designed day will not receive any collection until the following week on the normal collection day.
Section 4-2007. Residential Trash Collection.
(A.) In addition to residential garbage collection as described in Section 4-2006, the Town shall provide collection of trash once a week based on the collection policy of the Town for residential trash. (B.) In order to receive trash collection service, residents shall prepare trash for collection as follows:
1. All trash shall be placed adjacent to the curb or street edge, but not in the street, paved gutters or drainage ditches. 2. The Town will collect unbagged leaves and pine straw during the months of November, December, and January if property owners or occupants place leaves and pine straw next to the curb or street edge. 3. Furniture, large tree stumps, appliances and items weighing more than fifty (50) pounds will be picked up upon request. The Town shall collect appliances only after a request and payment is made as a fee in advance for the appliance pick-up. Each appliance requested for collection constitutes a separate fee. The fee shall be as prescribed by the Town Board based on the Town adopted fee schedule. 4. It is not the intent of this section or any other section of the Town code that the Town shall be obligated to collect and dispose of building rubbish left by builders, to collect and dispose of trees, limbs, and stumps left by tree surgeons, or to collect and dispose of any similar materials resulting from such specialized, intermittent commercial activities. This shall be the responsibility of the property owner or their agent.
Section 4-2008. Accumulation of Garbage, Refuse, Rubbish, and Waste Prohibited.
(A.) No property owner or tenant shall allow the accumulation of garbage, refuse, rubbish, or wastes upon property owned or occupied by him so that such accumulation is dangerous or prejudicial to the public health. (B.) Where such an accumulation exists for any reason, the Town may summarily remove, abate, or remedy such accumulation and the expense of the action shall be paid by the person in default, and if not paid, a lien shall be placed upon the land or premises where the trouble arose and shall be collected as unpaid taxes.
Please have your container at the curbside for collection no earlier than 7:00 p.m. on the day proceeding a designated pick-up day, and removed from curbside no later than 7:00 p.m. after the container is emptied. Your garbage will be picked up once per week. If container is not out at proper location on your designated day, you will not receive any collection until the following week on the normal collection day.
