Request: Rezone 13 acres from Commercial Downtown Fringe (CDF), Industrial, and Office & Institutional (OI) to Commercial Downtown (CD).

Rezoning Petitioner: Town of Fuquay-Varina

Property Owners: 25 parcels - List attached

Location: The site is in the middle of town on the north side of Academy St and south of Jones St, between Railroad St and N Fuquay Ave.

Existing Land Use and Surroundings: The site contains several businesses along N Main St and Academy St. The area for rezoning is bordered on the West by the Norfolk Southern railroad and residential land zoned Residential 10; on the north by commercial zoned Commercial Downtown Fringe; on the east by business zoned Industrial and Office & Institutional; and on the south by downtown business zoned Commercial Downtown and Office & Institutional.

Roads: Access is from N Main S, Academy St, Ellis St, and Jones St.

Utilities: The area has Town water and sewer.

Significant Natural Resources: The proposed rezoning site is in the Kenneth Creek watershed of the Cape Fear River Basin and has no significant natural resources.

Recommendation: Approval is recommended. The proposal for rezoning is consistent with the land use plan which indicates that commercial land use is the best use for this area. Earlier this year during a public hearing at a Town Board meeting, Charles Parker (owner of Parker Furniture) suggested that the Commercial Downtown District (CD) be extended north of the intersection of Main Street and Academy Street. Further discussions were held with the Fuquay-Varina Revitalization Association. As a result of these discussions, a meeting with property owners was held with the Town of Fuquay-Varina as an informal fact-gathering meeting to discuss the impacts of expanding the current Commercial Downtown District.

Attached is a table comparing the standards of the Commercial Downtown (CD) district with the three districts that are proposed to be replaced in the designated area.
