Request: Rezone 0.7 acres from Residential 30 (R30) to Commercial Highway (CH)

Location: The site is north of the corporate limits on the west side of HWY 401 across from Banks Road.
Existing Land Use and Surroundings: The site contains 5 structures built around 1950, with the largest one renovated as a convenience store/gas station. The site is surrounded by vacant land, zoned R30 to the south, Industrial to the west and north, and land zoned Light Industrial and CDF II along Banks Rd to the east.
Roads: Access is from Fayetteville Rd.
Utilities: Water and sewer are available.
Significant Natural Resources: The proposed rezoning site is in the Middle Creek watershed of the Neuse River Basin and no significant natural resources.
Staff Recommendation: Approval is recommended. Although the proposal for rezoning is not consistent with the land use plan which shows Industry & Employment land use for this site, Commercial land use and Commercial Highway zoning is reasonable considering the size of the tract ,and is the appropriate zoning for reuse of the existing convenience store/gas station.
